Оскільки єдиного закону для всієї Австрії стосовно практичної реалізації так і не було прийнято, прогалину законодавства заповнювала юдикатура Імперського суду (тип вищого конституційного суду) та Найвищого адміністративного суду. Наприкінці монархії було прийнято крайові закони у трьох коронних краях (Моравії, Буковині, Галичині). В Галичині цей закон через початок Першої світової війни реалізований не був. Artikel 19 des Staatsgrundgesetzes über die allgemeinen Rechte der Staatsbürger von 1867 statuierte die Gleichberechtigung der Nationalitäten und die Gleichberechtigung aller landesüblichen Sprachen in Schule, Amt und öffentlichem Leben. Da ein Gesetz für ganz Österreich betreffend die praktische Durchführung nie zu Stande kam, ersetzte die Judikatur des Reichsgerichts (eine Art Verfassungsgerichtshof) und des Verwaltungsgerichtshofs die Lücke der Gesetzgebung. Gegen Ende der Monarchie wurden Landesgesetze in drei Kronländern (Mähren, Bukowina, Galizien) angenommen (In Galizien wegen Ausbruch des Ersten Weltkrieges nicht mehr umgesetzt). Article 19 of the Fundamental Law on the General Rights of citizens, part of the Constitution of 1867, provided for equal rights of the nationalities, and also equal treatment for the languages spoken in the Austrian lands in schools, public office and public life. Since a law regulating the details of putting this into practice for the whole of Austria never materialized, the two highest courts – Reichsgericht (a kind of constitutional court) and Verwaltungsgerichtshof (high administrative tribunal), supplied with their judicature the legislative gap. Toward the end of the monarchy, provincial laws in three crownlands (Moravia, Bukovina, Galicia) were adopted (in Galicia not carried out due to the outbreak of World War I).
